Like many nations around the world, New Zealand over the last year has engaged in a serious and intense debate about government surveillance. The nation’s prime minister, John Key of the National Party, has denied that New Zealand’s spy agency GCSB engages in mass surveillance, mostly as a means of convincing the country to enact a new law vesting the agency with greater powers. This week, as a national election approaches, Key repeated those denials in anticipation of a report in The Intercept today exposing the Key government’s actions in implementing a system to record citizens’ metadata.
Let me be clear: any statement that mass surveillance is not performed in New Zealand, or that the internet communications are not comprehensively intercepted and monitored, or that this is not intentionally and actively abetted by the GCSB, is categorically false. If you live in New Zealand, you are being watched. At the NSA I routinely came across the communications of New Zealanders in my work with a mass surveillance tool we share with GCSB, called “XKEYSCORE.” It allows total, granular access to the database of communications collected in the course of mass surveillance. It is not limited to or even used largely for the purposes of cybersecurity, as has been claimed, but is instead used primarily for reading individuals’ private email, text messages, and internet traffic. I know this because it was my full-time job in Hawaii, where I worked every day in an NSA facility with a top secret clearance.
The prime minister’s claim to the public, that “there is no and there never has been any mass surveillance” is false. The GCSB, whose operations he is responsible for, is directly involved in the untargeted, bulk interception and algorithmic analysis of private communications sent via internet, satellite, radio, and phone networks.
If you have doubts, which would be quite reasonable, given what the last year showed us about the dangers of taking government officials at their word, I invite you to confirm this for yourself. Actual pictures and classified documentation of XKEYSCORE are available online now, and their authenticity is not contested by any government. Within them you’ll find that the XKEYSCORE system offers, but does not require for use, something called a “Five Eyes Defeat,” the Five Eyes being the U.S., U.K., Canada, Australia, and yes, New Zealand.
This might seem like a small detail, but it’s very important. The Five Eyes Defeat is an optional filter, a single checkbox. It allows me, the analyst, to prevent search results from being returned on those countries from a particular search. Ask yourself: why do analysts have a checkbox on a top secret system that hides the results of mass surveillance in New Zealand if there is no mass surveillance in New Zealand?
The answer, one that the government of New Zealand has not been honest about, is that despite claims to the contrary, mass surveillance is real and happening as we speak. The GCSB provides mass surveillance data into XKEYSCORE. They also provide access to the communications of millions of New Zealanders to the NSA at facilities such as the GCSB station at Waihopai, and the Prime Minister is personally aware of this fact. Importantly, they do not merely use XKEYSCORE, but also actively and directly develop mass surveillance algorithms for it. GCSB’s involvement with XKEYSCORE is not a theory, and it is not a future plan. The claim that it never went ahead, and that New Zealand merely “looked at” but never participated in the Five Eyes’ system of mass surveillance is false, and the GCSB’s past and continuing involvement with XKEYSCORE is irrefutable.
But what does it mean?
It means they have the ability see every website you visit, every text message you send, every call you make, every ticket you purchase, every donation you make, and every book you order online. From “I’m headed to church” to “I hate my boss” to “She’s in the hospital,” the GCSB is there. Your words are intercepted, stored, and analyzed by algorithms long before they’re ever read by your intended recipient.
Faced with reasonable doubts, ask yourself just what it is that stands between these most deeply personal communications and the governments of not just in New Zealand, but also the U.S., Canada, the U.K., and Australia?
The answer is that solitary checkbox, the Five Eyes Defeat. One checkbox is what separates our most sacred rights from the graveyard of lost liberty. When an officer of the government wants to know everything about everyone in their society, they don’t even have to make a technical change. They simply uncheck the box. The question before us is no longer “why was this done without the consent and debate of the people of this country,” but “what are we going to do about it?”
This government may have total control over the checkbox today, but come Sept. 20, New Zealanders have a checkbox of their own. If you live in New Zealand, whatever party you choose to vote for, bear in mind the opportunity to send a message that this government won’t need to spy on us to hear: The liberties of free people cannot be changed behind closed doors. It’s time to stand up. It’s time to restore our democracies. It’s time to take back our rights. And it starts with you.
National security has become the National Party’s security. What we’re seeing today is that in New Zealand, the balance between the public’s right to know and the propriety of a secret is determined by a single factor: the political advantage it offers to a specific party and or a specific politician. This misuse of New Zealand’s spying apparatus for the benefit of a single individual is a historic concern, because even if you believe today’s prime minister is beyond reproach, he will not remain in power forever. What happens tomorrow, when a different leader assumes the same power to conceal and reveal things from the citizenry based not on what is required by free societies, but rather on what needs to be said to keep them in power?

The Mana party was just a vehicle for this with Greenwald et al all being paid off in service of this aim and hardly disinterested observers looking out for NZ. This tactic of trying to scare people with claims of mass surveillance and disrupt an nations democratic process didn’t work and Internet Mana paid at the polls and the country delivered an unprecedented result under our MMP electoral system which normally means coalition governments in voting back National by a landslide. Some individuals are convinced they couldn’t live with themselves if they did nothing, but few ever sacrificed everything because they believed they had to do – something. I’m pretty sure it’s an attribute that defines heroes.
My house began celebrating a different Thanksgiving last year, and I named the Friday after the traditional holiday – “SnowMann Day.” It was south-of-the-border food and USA-upside-down-cake, but the associated traditions are still a work in progress. This year SnowMann Day is Friday, November 28th and I’m considering Middle Eastern kabobs and hummus, but there’s time yet. Edward Snowden talked about the mass surveillance he saw as part of the NSA, which proved yet again what is common knowledge that the US spied on its allies – which it was also doing in the 70s 80s and 90s – anyone remember the Falcon and the Snowman?
However, Mr Snowden could not not or did not provide any evidence that the GSCB had been spying on Kiwis. The best that was provided was it may be possible if GCSB have the same tick boxes as the US NSA people did.

CRIMES AGAINST HUMANITY FROM THE HIGHEST LEVELS
As with the case of the NZ PM countries around the globe are being over run by criminal elements seeking control and power by ways and means of secrecy and deception.

Modus operandi (plural modi operandi) is a Latin phrase, approximately translated as “method of operation”. The term is used to describe someone’s habits of working, particularly in the context of business or criminal investigations.
SOLUTIONS are what we are looking for to END this criminal crime spree covering centuries. Suggestions.
1. The solution needs to be on a global scale.
2. Justice is required not revenge.
3. A new world court of Justice needs to have the power to prosecute and sentence the wrong doers, regardless of who they think they are.
4. Humanity needs to regain what it has lost, its dignity, wealth, and a future without all those forms of debt and physical slavery we endure today, the media manipulation, the totalitarian laws & controls, the wars for profit, endless lies, the evil deceptions and the end to the game they play upon us: DIVIDE AND CONQUER.

Well there is certainly a worldwide global attempt at “control”, by whom/directed by whom, has yet to be determined. You do realize of course that people are being tortured to death in the United States. No not in prison or some black site…in their homes. Edward, is it possible that the NZ communications you were seeing were only those intercepted outside of NZ? My point is that if the fibre cables going out of NZ were tapped in Hawaii or further down the track, a substantial proportion of NZ communications could be intercepted without it being done within NZ. This matters because of John Key’s assurances that mass surveillance is not done in NZ. One other possibility for John Key to be telling the truth would be if the tapping were done on US soil in NZ, ie in say a US embassy. Technically, that’s still not in NZ… would be interested to hear your answer.

If you have the time and interest, I’d be interested in your thoughts about a communication I received last year from a U.S. Navy petty officer alleging that when he showed up for a polygraph test, he was confronted with a printout of logs showing what websites he had visited the night before, on his personal computer, using his personal ISP. If what the petty officer told me is true, this would be an example of the U.S. government targeting a U.S. citizen visiting a legal website run by a U.S. citizen (myself) and exploiting that surveillance in near real time.
Does the petty officer’s account seem plausible to you? Are you aware of any program targeting the communications of individuals who work in the intelligence field, or of sites like AntiPolygraph.org that are critical of aspects of federal policies?

That depends on whether or not he was using TOR. Of course if you visit that sort of site the day before it would seem fishy, and they can and will use that against you.
Now if he was using TOR and they still found out, likely his computer/network was compromised as well.

I can tell you a fact that the hardware is in place, not tapped into the Southern Cross cable at sea (which their director has said is impossible) but at, at least one of the demarcation points of this cable onto New Zealand’s telecommunications infrastructure. Its a black unit smaller than a briefcase which intercepts everything, located in a datacentre, in a non-descript building in downtown Auckland, no prizes for guessing who owns that building though.

This is where the argument falls down. John Key has clearly lied consistently about the implementation of mass surveillance. He is the epitome of reproachability.
John Key would love to abuse his power, but he bungles it every time. So while a succession of leaders beyond reproach is highly unlikely – that condition is not a necessary one. A succession of incompetent leaders is not only possible, but highly likely. People have a knack for electing leaders who are incompetent, and thus hanging on to a measure of their freedom far longer than they actually deserve. It is necessary to trick them into electing a competent leader by creating an external threat to frighten them.

Once again….the word thank you hardly suffices but it is all that I have.
The 13 principles is a good start but upon reading them I noticed so many exceptions and qualifiers as to make them nearly impotent. I particulaly woke up on the word “imminent” which is used many times as a bypass valve. We have perhaps a singular moment in history here to get it right. That word “imminent” has been stretched so far out of shape by our government running the drone warfare as to be unrecognizeable. “Imminent” to them means sometime, possibly, maybe in the future the target in question has the ability to inflict damage to us and our interests. If we give the government an opening to manipulate, obfuscate, or otherwise redefine words, they will do so. Just my two cents worth. If we don’t get this right I’m afraid we won’t get another opportunity.

Edward it is great to see you publishing on The Intercept! I really enjoyed the piece. As for the mass surveillance currently underway in the “Five Eyes” I personally find it really invasive and disturbing. What our government has done in the name of security is appalling and makes the case that conspiracy theorists have been screaming for years. It makes you think what caused this atmosphere? The 9/11 attacks. It makes me question what really happened that day and if maybe our government really did have something to do with it in order to get the access that they have today to our communications. It really does make sense if you think about it. Its possible.

@art guerrilla. I “disenfranchised” myself (literally took myself off the voting roll) several years ago after voting in EVERY election since I was 18 (and that was a lot of elections). Slowly I woke up and realized I was just a tool for a system and I didn’t want to lend myself to such a use or to tacitly endorse the system by voting. Writing in Mr. Snowden’s name is a good idea but I think it is even better to just not vote at all. (To those of you that argue not voting is irresponsible, I would ask you to reconsider your beliefs that voting really matters.) The “system” runs a certain way and nothing will change that until it is replaced. Yes, the Empire must fall.
Mr. Snowden, although you continually wish to convey the notion that the surveillance story is not about you, the fact you continue to interject yourself and your opinion into the debate means otherwise. Therefore, your credibility is also an issue for people to consider when assessing what you write and say. You claim to have made numerous efforts to internally complain about the domestic surveillance activities of the NSA, yet no proof has actually surfaced to support your assertion. In a recent FOIA lawsuit for your alleged e-mails the NSA has filed a sworn declaration stating no such documents were identified. That means the burden is on you to prove what you assert. Do you have copies of your e-mails? Who specifically in NSA or elsewhere within the USGOVT did you contact to complain about the NSA programs you believe to be illegal? These are very straightforward and simple questions one would think you could easily answer. Why don’t you?
Mark; I regularly visit your FB page and you are really stuck in 1st gear. Snowden is not a hero, is your mantra as you navigate the shoals of those legal options you feel are sufficient. I have some respect for the work you’ve done, but it seems silly to repeat your challenges to Snowden when there are far more malignant forces at work within the system you approve of.

I don’t agree with you on some things but I do agree with you that Snowden does constantly interject in a way that can be construed the way you put it. I want to think the best of people but I have questions over why Snowden would do things the way he did. Maybe there is a partially viable answer. He could have made himself known at a later point or anonymously participated in the debate. It just makes me wonder exactly why he chose to make himself known when he did. For the record: I completely agree with the NSA revelations and I used to wholeheartedly support Snowden but the way most people talk about him makes him sound like an idol or pop icon which is not good for the cause in the long run.

Having broken the two links taboo, as I wait to see if my comment will display, I’d make the observation that these revelations so close to the election are nearly guaranteed to provoke some real anxiety in NZ voters. There’s nothing like having something real, real important, and real important right now to focus the mind. And, that focus – that anxiety – can prompt a fight, or a flight, response. Voters – perhaps accustomed to cruising through an election on autopilot – are confronted with something that should matter to them. And, that matter requires some kind of action. Voters either have to consider their full array of choices – examine their priorities and preferences – in the face of new, or newly confirmed, information, and reassess. Some will instantly default to defending their previous predilections; no heavy mental,emotional or civic lifting for them! The You can’t make me do it! response. Others will have to confront trade-offs they’d have preferred to avoid. In either case, the voters of NZ are going to get to “own” the outcome, and all that follows. The ignorance is bliss; but, I didn’t know option has been removed.

But what about those voters who were on the fence or unsure? And, if other media outlets had amplified the story, it’s possible that we might have had a different election outcome…. and, it’s also possible that all of the events that followed that 2004 election might have had different outcomes as well. *sigh* If only…

The Five Eyes concept seems to be a very short-sighted arrangement if your goal is to implement a GLOBAL mass surveillance and terrorism structure before it is discovered by the rest of the world. Yes, the US and UK corporate governments are terrorist organizations of the first order, never hesitating to use their armed forces to terrorize wherever they can, but the other three members of the group are sorely lacking in this activity. So why were they chosen? Because the western corporate philosophy of complete control is most developed in them? Because they are raw materials sources? Because the populations are so deeply consumerism based? Simply because the cultures of those countries are so attuned to accepting the terrorism of the two leader states as being good for the world? So many questions.
It seems to this observer that the US and the UK corporations and the governments that serve them would have been smarter to have slithered into bed with the Chinese, Germans, and Russians corporate/governmental organizations before being discovered.

It’s inexplicable how Key can just rumble on no matter what’s put in his way. I watched the meeting on Monday night and as Ed Snowden and Glenn Greenwald spoke, I thought: ‘Gotcha! Even our slime-ball PM can’t possibly climb out from under this.’ But he has! He opens his lying mouth, spews out any old thing (today, for example, when asked about NSA spy bases he said he didn’t know but nor did he know if Martians were in NZ) and the media and at least half the people in the country lap this nonsense up.
I’m starting to think he’s sold his soul to the devil because how else can you explain how he survives multiple train wrecks? Four or five times this election campaign he’s been hit by such major issues that his career should have imploded. Snowden, Greenwald and co produced the most wonderful, convincing argument the other night, yet it was lost on so many. In response, Key calls them henchmen and his followers parrot that blindly.
I just don’t know how Snowden and Greenwald, or anyone else, can top their stunning Moment of Truth and prove the emperor has been suffering a total wardrobe malfunction for six or seven years. It appears nothing is going to sink into his followers’ thick heads. How dumb a people are we?

If John Key does not resign by the end of this new day, he should be forcibly removed from politics in this country.
Fellow New Zealanders, I say we demand that the national party removes John Key from his position and appoints a new leader to stand in the general election on the 20th. Even if you support the national party, this man has lost his right to participate in New Zealand politics and should be indicted on charges of corruption, treason and purgery. There may be others who should face similar charges, within and outside of the political sphere, and justice MUST be done.
Am I advocating a witchhunt to oust those who facilitated this breach of our human rights and consistent stream of lies from our highest office?

Hardly a revelation, Key has been extremely guarded when questioned regarding these issues and chosen ways to deliver safe answers without anyone being able to pin him down to a definite answer. However, at last the cat is out of the bag and he is exposed for what he is – less than totally honest.

Snowden did not seek asylum in Russia. In attempting to gain residence in Central America, Snowden’s right to travel freely was removed by the US, and he became stranded in Russia. If Snowden was allowed to travel unhindered, he would not be in Russia today.

What was the mechanism(s) used to test and trap all that data? Who was the connector? Im not sure who to believe, Snowden + Dotcom or the Prime Minister. However, Snowden undermines his case by seeking asylum in Russia. He may have had few choices on where to go, but surely he can see the irony of the situation, and how his living arrangements compromise his credibility.
That Russia was the only place he could go and be protected from US hit men is testament to how close the world is to a world government–a government that is totally corrupt and makes the mafia look like naughty children. Is there any additional proof that Key lied about New Zealand stopping short on participating in XKEYSCORE? The proof Snowden furnishes here actually seems pretty weak. The fact that there is a checkbox allowing you to filter out New Zealand is suspicious, but isn’t dispositive. NSA, or whoever else created that program could easily argue that it was inserted as a default for all Five Eyes members, or that it was inserted when New Zealand was assumed to be cooperating but is otherwise not functional.
We would need actual proof that New Zealand is actively and presently feeding information into XKEYSCORE, not circumstantial evidence about the program structure that seems to indicate New Zealand’s involvement.
Snowden just appeared with Greenwald and Kim Dotcom, as well as Assange, at the Moment of truth event in Auckland. He emphatically said he had access to NZ mass data when he used XKeyscore.

Today on Twitter there was a tweet sent out by the UN about teaching our youth in different countries about democracy.
I tweeted a reply and I said that Democracy doesn’t exist and that my truth was more credible than their fiction.
Your courage to leave your loved ones and to leave your home in order to show the citizens across the global estate that democracy doesn’t exist anymore as we knew it and why, takes a special kind of human being who has seen the evil at work firsthand and regardless of the fact you were an employee contracted to engage in that same evil, your inner-being told you and you listened that what was occurring was not only immoral and intrusive but also crossed the boundary of what is an invasion of a basic human right to privacy and dignity.
It feels like one has been raped but you don’t know or cannot see who your rapist is.

i had a client who accidentally anchored in the area where the southern cross cable exits onto takapuna beach . It was an honest mistake undertaken because of storm conditions. He had never had any convictions of any sort and was entitled to diversion, but was refused diversion and the police asked for a fine of $20,000 . he had been there just 10 mins when he was approached by security, so it was clearly monitored with rigour. Clearly they were very tense at this time about the area. I wonder, in the light of the new revelations , why? …They were preparing it for the probe…..

They break the law because your home is yours and what is in it is yours. It’s the same with whatever’s on your computer, what’s in your emails, the calls you make, the sex vids and everything else. This is just oppressive and it really makes me want to give up my computer and my cell phone. Knowing that you are being watched 24/7 has a profound psychological effect that makes you feel less free and instigates paranoia. Why would a govt do this to its people? Surely there are psychological studies that address the long-term deleterious mental effects of surveillance.
People are being watched in their homes, as well, and not just via their computers. But the hard evidence hasn’t yet come to light and those who dare to speak of it are called “paranoid” and “delusional.”

When I lived in New Zealand, I was a member of and campaigned for the Libertarianz, which was at the time the only party that stood for individual liberty. It’s my understanding that they are no longer registered as a political party, and that ACT has (finally!) taken that particular torch and run with it. But ACT has had parliamentary representation, and their founding members have served in the cabinet. It would be interesting to know whether they, too, condoned and then lied about surveillance like Mr. Key has done.
At this point in time the mainstream media in NZ such as Fairfax are not providing the public with even the name of this site, let alone its url. They are mentioning the existence of this information, but are not helping anyone to see it for themselves

Gen. Herc – Our judiciary doesn’t have the power that the Australian and US ones have. Our Westminster system lost its last true check and balance when National sent the suicide squad to remove our Upper House.
Now all we have is MMP as an effective check and balance on the power of our elected government’s and even that is something they want to change.
We’ve got it good in NZ, but we’re slack in recognising our faults sometimes.

I had known for years that our democracies were far from being democratic, but it took your courage to expose the all consuming secrecy we see and live under, and you did it with documentation. I wish I was more optimistic about the rest of the citizenry actually being citizens. I speak to whomever will listen and sadly that’s not very many. Of those who appear to listen, almost all have a glazed far away look as if they are hypnotized. Keep up the good work and some will try to do the same.

It is about time that New Zealanders wake-up and stop living in denial about NZ not being a part of this. Most believe we do not have it here but in a country where a PM can overturn a civil issue and make it a legal issue like arresting students at the border who student loans have gone into default- does this tell you something… The only sad thing is that today Kiwis will hear a bit on the telly coming from non-Kiwis- Greenwald, Assange and Snowden, and only the Kiwis keep lying- those defending the mass surveillance program… the truth does have to come from a Kiwi, believe it or not, for Kiwis to open their minds as if it comes from an outsider (esp an American) most will turn a deaf ear.
