One of the greatest free speech threats in the West is the growing, multi-nation campaign literally to outlaw advocacy of boycotting Israel. People get arrested in Paris — the site of the 2015 “free speech” (for Muslim critics) rally — for wearing pro-boycott T-shirts. Pro-boycott students on U.S. campuses — where the 1980s boycott of apartheid South Africa flourished — are routinely sanctioned for violating anti-discrimination policies. Canadian officials have threatened to criminally prosecute boycott advocates. British government bodies have legally barred certain types of boycott advocacy. Israel itself has outright criminalized advocacy of such boycotts. Notably, all of this has been undertaken with barely a peep from those who styled themselves free speech crusaders when it came time to defend anti-Muslim cartoons.
But now, New York’s Democratic Gov. Andrew Cuomo (above, in the 2016 Celebrate Israel Parade) has significantly escalated this free speech attack on U.S. soil, aimed at U.S. citizens. The prince of the New York political dynasty yesterday issued an executive order directing all agencies under his control to terminate any and all business with companies or organizations that support a boycott of Israel. It ensures that citizens who hold and express a particular view are punished through the denial of benefits that other citizens enjoy: a classic free speech violation (imagine if Cuomo issued an order stating that “anyone who expresses conservative viewpoints shall have all state benefits immediately terminated”).
Even more disturbing, Cuomo’s executive order requires that one of his commissioners compile “a list of institutions and companies” that — “either directly or through a parent or subsidiary” — support a boycott. That government list is then posted publicly, and the burden falls on them to prove to the state that they do not, in fact, support such a boycott. Donna Lieberman, executive director of the New York Civil Liberties Union, told The Intercept: “Whenever the government creates a blacklist based on political views it raises serious First Amendment concerns and this is no exception.” Reason’s Robby Soave denounced it today as “brazenly autocratic.”
To read the relevant provisions of Cuomo’s order is to confront the mentality of petty censoring tyranny, flavored with McCarthyite public shaming, in its purest form. See for yourself:
Making matters worse still is the imperious nature of Cuomo’s order. As Salon’s Ben Norton noted, “The New York legislature has unsuccessfully tried to push through anti-boycott legislation for months.” So instead, Cuomo just unilaterally decreed this punishment of boycott advocates.
New York’s Democratic Sen. Chuck Schumer wasted no time, now demanding a federal statute that tracks Cuomo’s order. Hillary Clinton, last July, wrote a public letter to her (and the Democratic Party’s) billionaire supporter, self-described Israel fanatic Haim Saban, endorsing the core principle of this censorship effort — that boycotting Israel is a form of anti-Semitism — and did so again in her March speech before AIPAC. Numerous Republicans support similar measures.
Beyond the McCarthyism and profound free speech threat, the stench of hypocrisy of Cuomo and Democrats is suffocating. Just over two months ago, Cuomo banned state officials from traveling to North Carolina in order to support the boycott against that American state in protest over its anti-transgender law. That pro-boycott executive order from Cuomo began by proclaiming that “New York state is a national leader in protecting the civil rights and liberties of all of its citizens” and thus barred “publicly funded travel” to North Carolina.
But in justifying this punishment for Israel critics, Cuomo’s counsel told the New York Times: “It’s one thing to say I want to engage in political speech. It’s another thing to say I’m going to sanction you or penalize you for engaging in commercial activity.” But that — “I’m going to sanction you or penalize you for engaging in commercial activity” — is exactly what Cuomo did just two months ago by boycotting North Carolina. Think about how warped that is: To the governor of New York, it’s not only permissible but noble to boycott an American state, but it’s immoral and worthy of punishment to boycott Israel, a foreign country guilty of a decadeslong brutal and illegal occupation. Questions submitted by The Intercept to Cuomo were not answered as of publication.
More ironic still is that Cuomo, in imposing a boycott of North Carolina, said he was doing so because in “a free society the equal rights of all citizens … must be protected and cherished” — exactly the principle that the boycott of Israel is seeking to fulfill by ending oppression and discrimination against Palestinians. But even if you disagree with the Israel boycott itself, no rational person should want Andrew Cuomo and other elected officials to have the power to dictate which political views are acceptable and which ones result in denial of state benefits.
The free speech hypocrisy on the part of all sorts of people here is obvious. In 2012, conservatives were furious when Chicago Mayor Rahm Emanuel announced that he would block the restaurant chain Chick-fil-A from expanding in the city as punishment for its owner’s anti-gay activism, depicting this move as a grave threat to free speech (a position we shared). Throughout 2015, pundits such as New York’s Jonathan Chait wrapped themselves in the free speech flag when it came time to defend racist and anti-gay speech on campus, insisting that all forms of speech, even “hate speech,” should be protected (positions we also share).
Yet now, a systematic, international campaign — fully bipartisan in the U.S. — is being implemented to abuse state resources and the force of law for a full-frontal assault on free speech and free assembly rights, and virtually none of them is objecting because it’s all in service of protecting Israel from criticism. It’s bizarre enough that someone gets elected as governor of New York and then believes it’s part of his job to shield Israel from criticism. That he does so by assaulting the free speech rights of citizens of his own country — just weeks after imposing a boycott on another American state — tells you all you need to know about the role Israel continues to play in American discourse and the willingness of people to stomp on free speech principles the moment doing so benefits their political goals.

NPR host Brian Lehrer brings up the N. Carolina issue via Alan Dershowitz, to which Alphonso David (Cuomo’s counsel) responds: “I think it’s curious that the governor issued an executive order prohibiting state employees from traveling to N. Carolina because N. Carolina has a policy…that discriminates against LGBT individuals. We didn’t hear the same arguments that we’re hearing now [against the proposed anti-BDS blacklist].” It seems the reason Alphonso David can make such an apparently nonsensical and contradictory statement, cited by Greenwald and Fishman above, is because Cuomo and David view the anti-LGBTQ legislation of N. Carolina and the international BDS movement as sharing a likeness (he also absurdly raises the KKK as another example of similarity earlier in the interview) in that they are both “bigotry” and worthy of being boycotted, whereas the Israeli government is somehow by definition only the object of bigotry and not the perpetrator, ever, a priori, case closed. Further, he almost seems to point to the State of New York as having some kind of privileged status as a boycotter, as if to say only powerful governments have the ability to choose who the correct target of boycotts, sanctions, and divestments should be.
It is a violation of the FIRST AMENDMENT for government to interfere.

(2)Boycotts are the most Democratic and PEACEFUL of actions.
(3) Boycotts are FREEDOM of SPEECH.

Good discussion of the Cuomo order on MSNBC today, featuring the Jewish-American writer Dave Zirin and a very smart female Palestinian-American activist whose name I missed. Zirin made the point that Cuomo’s recent praise of Muhammad Ali rings exceedingly hollow in view of Ali’s pro-Palestinian sympathies and legendary insistence on freedom of thought and action.
Governor Cuomo is absolutely correct that we do not discriminate. What the Governor said is that they do not want to put their money into funds that discriminate against Israel. the state of NY has every right to chose where they are putting their money. They are not telling you that you can not invest in funds that do not invest in companies that do not do business with Israel. These groups are discriminating against Israel and the Jews. That is called anti-Semitism.
Glen, I think you should explain why this boycott is not discrimination. Regardless of how anyone feels about Isreal or BDS, the fact remains that this is not discrimination.
Clinton and Cuomo want to force companies to quit boycotting Isreal or else quit doing business with government agencies. They are trying to portray an economic boycott as discrimination, and acting as if not doing business with a race is the same as not doing business with a country.

Business owners can refuse to serve customers, but must be careful that the denial of service is based on customer behavior, decorum or the health and safety of patrons and employees. That Arab-Muslims spearheaded a continuation of the Nazi war against Jews is demonstrated in the fact that an Arabic translation of Adolf Hitler’s Mein Kampf is a long-time and current best-seller in many Arab countries.
The lion’s share of the British Mandate became Jordan in 1921.
Jews whose families had lived there for hundreds of years were stripped of citizenship – only because they were Jewish – (the same thing that happened *later* to German Jews under the Nazis) – and got pushed into the remaining 25% of the British Mandate.
Those same Jewish families, expelled from Jordan, became a target of Arab-led pogroms in that remaining 25% of the Mandate.
When, in 1947, the U.N. proposed a two-state solution to the conflict, Middle Eastern Jews accepted the proposal; Arabs rejected it and their only counter-offer was a war with the Nazistic threat of “driving the Jews into the sea.”
Had Arabs, like Jews in 1947 accepted the two-state proposal, there would have been no wars, no refugees, and there would have been mutual prosperity for the Jewish and the Arab states.
What was the Arab world’s reaction to the failure to carry out the Nazistic threat to “drive the Jews into the sea”?

– The BDS movement promotes hate of Israel’s very existence, promotes hate of every single thing Israel does to protect itself, promotes hate of Israelis as a nationality, and promotes bigotry and discrimination against Israeli universities, musicians, artists, etc. No other universities, artists, etc in the world are deemed guilty of whatever wrong their country may do. Only Israeli Jews are singled out for this sort of hate.

We also should not forget that the BDS founders (falsely) compare Israel to Apartheid South Africa because of the land and immigration laws that favor Jews (which maintains a Jewish majority); thus, the BDS movement seeks to end Jewish majority rule (by making Jews a minority in their own state with equal voting rights for all) just as the BDS movement ended white minority rule in South Africa. The founders of the BDS movement were not singing the praises of apartheid South Africa, but are seeking to end Jewish majority rule.
You cannot state that those are the ONLY goals of the BDS movement without looking at the implications of implementing 1-3. The implications are the primary goal of the BDS movement.
If the goal was to end the “occupation” of the West Bank and East Jerusalem to produce a viable two state solution, then they could drop numbers 2 and 3 above (and possibly settle on a just compensation for the Palestinian and Jewish refugees). By the way, that is a much more viable option which does not give false hope to Palestinian refugees.

The entity known as “Israel” is neither a country nor a state, i.e., it has yet to officially declare its borders and have then recognized as such by the world community.

Israel did declare its borders officially to President Truman on May 14th, 1948 and to the UN Security Council eight days later. The major issue is that Israel is outside of those borders and has been for 72% of its life as a state. (Not including Jerusalem that has always been illegally occupied by Israel.)

Per the recommendatory only 1947 Partition Plan, which was grossly unfair to the Palestinian Arabs, never adopted by the UNSC, and in violation of the terms of the British Mandate 1947, Ben-Gurion, et al, did accept 56% of mandated Palestine as the borders of the “Jewish state” effective 15 May 1948. Of course, this was after Jewish forces had dispossessed and expelled about 400,000 Palestinians since late 1947 (which necessitated intervention by Arab state armies to stem the expulsions) and made several encroachments into that portion of Palestine that was to be an Arab state per the Partition Plan, e.g., Jaffa. As I’m sure you know, the IDF went on to expel a further 400,000 Palestinians and seize an additional 22% of Palestine, a total of 78%, which was in essence agreed to by the UNSC in Resolution 242 and accepted by the PLO when it signed the 1993 Oslo Accords.
During the war it launched on 5 June 1967, Israel occupied the remaining 22% of Palestine as well as Egypt’s Sinai, Syria’s Golan Heights and Lebanon’s Shebaa Farms, which apart from Sinai, it still occupies.
To cut to the chase, Israel has yet to renounce its claim to occupied East Jerusalem and the Golan Heights (both of which it has illegally annexed) or the West Bank (and the Shebaa Farms.) Israel has not officially stated that its borders do not include those lands it seized in 1967. Israel claims it has a right to all or portions of these lands and of course, it does not

This is not a chicken versus egg argument Craig. Palestine existed as a Class-A mandate state created under Article 22 (1,4) of the League of Nations Covenant twenty-four years before Israel became a state. 3) Jews having a state is apparently ‘racist,’ but Muslims having 50 countries and Arabs having 20 countries is somehow not racist.
4) Jewish nationalism is ‘racist’ yet somehow Palestinian nationalism is great, Arab nationalism is great, and Muslim nationalism is great.
5) There are ‘NO JEWS ALLOWED” Arab-only neighborhoods across the West Bank, Gaza, also in most of that entire region. To pro-BDS people, ‘NO JEWS ALLOWED’ Arab-only neighborhoods are acceptable, yet Jewish neighborhoods in the West Bank (which require army protection so Arabs don’t murder those Jews) are unacceptable.
6) Pro-BDS people place NO responsibility on anyone other than Israel to make peace. The people who surround Israel can try to murder as many Jews as they want, can try to kill as many Israelis as they want, Palestinians get to elect Hamas terrorists as their leaders, ISIS gets to take over Syria, Islamic Jihad get to continue to try to destroy Israel, all of this is OK to pro-BDS people. They just want Israel to commit suicide, ‘for peace.’ Why is this? Because 99% of pro-BDS people just want Israel erased/destroyed. Because BDS is a hate movement, not a peace or justice movement.
7) Bigotry from BDS against Israel’s very existence is peaceful, somehow. Apparently, in BDS land, helping Muslims destroy the only Jewish state is honorable. In the world of BDS, bigotry and discrimination against Israeli professors, scientists, musicians, artists, etc. is acceptable, yet bigotry against everyone else in the world is frowned upon. Even when Israel is bigoted against people who are trying to destroy Israel, apparently that’s wrong too. To BDS supporters, the only acceptable hate/bigotry in the entire world is the hate/bigotry directed at the tiny 1% of the Middle East that is Israel.
8) Bigotry from this activist against Israelis is good, yet if Israel discriminates against him in response then somehow Israel is being mean.
9) Hardcore discrimination against Israeli artists, universities, culture, politicians, businesses, etc. is acceptable, yet Israel protecting itself is bad and evil. Somehow, to pro-Palestinian activists and BDS supporters, the only universities in the world that are guilty of what their government does are Israeli universities. All the other universities across the entire world are magically innocent of what their government does.
10) BDS actively blacklisting Israelis is fine, yet if Israel blacklists the people responsible than Israel is being mean.
BDS is a hate movement whose goal isn’t to merely get Israel out of the West Bank. It’s a ‘final solution’ that, if successful and implemented, would literally eliminate the world’s only Jewish state specifically to form yet another Muslim state, and would put literally millions of Israeli Jews in mortal danger.

We should stop talking about the Democratic Party as if it is a progressive alternative to the (ultra) conservative Republican Party. It is not. The party has shifted so much to the right that it has become an extension of the RP; in fact the DP is democratic in name only.
The policies have become almost indistinguishable from the Republican policies, and the politicians are effectively Republicans in a Democrat coat, with Obama & Hillary Clinton being the archetypes of such wolves in sheep skin. Cuomo has obviously joined that “select” club.

I’m not too worried about the freedom of speech implications; the list will prove hard to administer. So the directive will probably be modified to ‘All NY State procurement can only be contracted through Cuomo Enterprises Limited’. This is more practical than having lawyers waste a lot of time arguing about a list, and sidesteps the freedom of speech issues.
The legislative branch may still have some concerns, since they deserve an opportunity to wet their beaks as well. But I’m sure this can resolved in close door meetings, once the constitutional issues have been dispatched.
There’s no need to make government more complicated than necessary.

That is completely false. The anti-BDS movement is not about protecting Israel from “criticism”. You are free to criticize Israel all you want. The Intercept has made an obsession of criticizing Israel. The goal of anti-BDS legislation is to prevent singling out Israel for an economic boycott which has the sole goal of ending the Jewish majority state (as outlined in your propaganda piece featuring an interview with Omar Barghouti) . Essentially, the movement seeks to (falsely and wrongly) compare Israel to Apartheid South Africa to generate an emotional connection between the plight of the Palestinians and black South Africans under apartheid – and create a single state with a Palestinian majority. Thus Jews would become second class citizens in their own country.
Additionally, the BDS campaign has nothing to do with Israel settlements east of the Green line. Why do you assume that being a (substantial and relatively wealthy) minority in a Palestinian-majority country would make Jews “second class citizens”? What if the country had laws providing equal rights to all? (Jews are a minority in America too, but we’re not second class citizens.)
If the more theocratic segments such as can be found in Hamas became trouble, you’d see a lot of us quickly pivot to spending time opposing them. (Of course, Israeli Jews would also have to get control of their alarmingly ascendant, theocratic, ultra-Orthodox freaks.)
That is a reasonable question – and, of course, there is no guarantee what might shake out of a single state solution. It could turn out to be a Utopian society.

There are other problems though, like how would the several million offspring of the refugees who lost their homes in 1968 settle since they would be allowed to return? Why are we assuming that Hamas or Islamic Jihad would become peaceful with such great wealth disparity – and such a bitter conflict?

It’s not like Batya Medad actually hides herself, she really really likes the limelight. She makes no secret of how proud she is of the Tel Shiloh archeology that the Israelis are stealing in broad daylight right in front of Hasbara trolls like Craig. Incidentally I’m not technically a reformed zionist as I was never one. This is pretty new to me. I came to be involved in this indirectly in 2001 with virtually not even MSM perversion yet. I was living a pretty hard life and always hated politics. My awareness started more after 9/11 and the drum beat of war. I hate war. But especially during the Gaza War 2014…I became a direct student of current affairs online…social media. (I had no computer until then) I am a student for truth…and became an ally for Palestinians and their cause. Greenwald and Fishman have no interests in free speech in the US. They are simply couching their anti-Israel activism in free speech. There has been an incredibly disproportionate amount of anti-Israel articles in the Intercept (unrelated to civil rights). Greenwald has compared Netanyahu with Goebbels. Greenwald (and Fishman) write:

You are the one debating the issue of free speech. I outlined in my first post exactly how deceptive the authors were concerning the goals of the BDS movement. They are not unique in this respect. They represent a large portion of BDS supporters who seek to deceive the public about the goals of the BDS movement. I agree with you 100 percent on the issue of free speech, however. They are free to lie and spread misinformation all they want – which they do.

Indeed, you ignored what I wrote calling the misinformation in this article irrelevant which is tantamount to saying lying in journalism is OK.
To answer your question, the government – state or federal (in the US) – should not be in the business of legislating to private businesses whether they decide to boycott Israel on humanitarian grounds. That is their decision – end of story. After all, those businesses are gambling that there will not be a backlash against their political decision. In fact, generally speaking, it is not a good business practice to take political stands on controversial issues which do not affect your business directly.

You are wrong. The goal of the BDS movement is to end Israel as a Jewish majority state. That is the primary goal. In Greensward’s interview of one of the founders of the BDS movement, Omar Barghouti, Greenwald asks,

What it does is simply point out the foolishness of labeling a position in support of the right of return of palestinian refugees as “inevitably destined to fail” since basically no one can predict the future. By allowing the return of the several million refugees and eliminating land and immigration laws which favor Jews (because they are a small minority world-wide), this will certainly lead to a Palestinian majority state – and you think I am grasping at straws? I know you are not dense, so you are choosing to ignore the clear implications of those changes demanded by the BDS movement. And the clear implications are the end to the Jewish majority state. That is their primary goal. Their (false) comparison of Israel to Apartheid South Africa is also a clear indication of their primary goal. There are many ways we could categorize people so that they fit in one small minority or another. For instance I’m pretty sure that Palestinians are just as much a “small minority worldwide” as Jews are. Are you also a militant for all groups to have their own country at the expense of others rights? Or is this concern of yours for plurality only limited to one specific religious group?
I’m not sure I understand your obsession for there being state that’s a jewish majority. I realize that you seem to be assuming that it’s really just self-justifying : THERE MUST BE ONE. Is there also a need for a Mormon state? I for one prefer secular states so the point that there was a need for a state that’s controlled by a consistent jewish majority hadn’t even crossed my mind. Just like I don’t feel that it’s essential that there be christian states or buddhist states. But if there’s a jewish state good for them. I have no problem with that. As long as this jewish state isn’t artificially maintained at the cost of depriving other human beings of their rights: the importance of a jewish majority state is not more important than human rights. Or will you explain to me exactly what’s so sacred about it? Obviously the many jewish supporters of BDS agree with me on that.
But regardless of that, how does the fact that one of the implications of what BDS seeks to accomlpish is the loss of the jewish majority makes it it’s goal. It’s a consequence. It might be purposely designed like that, and it might be just a consequence of it.

The best way for the BDS groups to respond to this is to expand their boycott in several ways:
1) Include the undeclared nuclear arsenal that Israel possesses in the rationale for the boycott, by including a demand that Israel agree to IAEA inspections of all nuclear facilities as a condition of future U.S. aid. It’s irrational that Israel continues to act like North Korea on the nuclear weapons issue, and to receive aid from the U.S. despite U.S. laws prohibiting aid to countries with clandestine nuclear weapons programs.
2) Include Saudi Arabia in the boycott movement, for obvious reasons, such as beheading political dissidents, the general lack of democracy, illegal assaults on Yemen, sponsorship of terrorist groups like ISIS, and treating women like second class citizens. Since Saudi Arabia is a quiet alliance with the Netanyahu government right now, this makes sense.
Remember, a good offense is your best defense against efforts to persecute and shut down the BDS movement. The South African anti-apartheid boycott faced similar pressure, yet succeeded in the end.
However, careful thought about what ‘success’ means is needed – the anti-apartheid didn’t push for one state for whites and another for blacks, but rather equal democratic rights for everyone in South Africa. What that means for the Israel – West Bank – Gaza region is that all three zones must be incorporated into one state, federally divided into states, perhaps, but where all members have the right to vote in Israeli national elections. Nothing else really makes sense.
Israel is a special case, as far as the US is concerned. Why? Because it was the US that most strongly backed the creation of a Jewish state in the aftermath of World War 2, because the US has provided hundreds of billions of dollars in aid and direct investment to keep the Israeli economy afloat, because the US through military aid, technology transfers and intelligence sharing ensures that Israel possesses the dominant military capability in the region, and because the US continues to provide unflinching support for all of Israel’s actions, for example at the UN. None of the foregoing apply to Saudi Arabia, or any other country for that matter.
In return for all we provide, we have the right to expect a modicum of good behavior on the part of the Israeli government. Since the Israelis are unconvinced of that, and since our own government is paralyzed by the specter of losing “the Jewish vote” (translation: millions in campaign contributions), it is up to us, the individual citizens, to bring economic pressure on Israel.
If the Zionists wish to pass laws against us, call us names, or imprison us, so be it. History is on our side.

This article is revealing, but what is even more important in my view is the fact that virtually all of the establishment will ignore this story, even though it illustrates a hideous perversion of authority and liberty. For what it’s worth I think this law is stupid and redundant. BDS is never really going to succeed in changing Israel, it will just piss off campus Zionists like Alan Dershowitz. Israel is too clever to be boxed in by a boycott. Their main exports are high end technology, you can’t just get that anywhere. Even the South African boycott was found to have very little economic effect and that was with the entertainment sector backing it. Face it, Oberlin College divesting from Israel doesn’t do a whole lot.

Ah, now, historically speaking Zionism is an early 20th century concept, very similar to the Marcus Garvey ‘back-to-Africa’ effort seen in the United States in the 1920s, or the previous Liberian colony in African in the post-American civil war era. The similarities are many – from wiki:

The rationale behind those movements was that the U.S. and Europe had become so unaccepting of minority groups that the only option for them was to leave the country and find their own home in some other region of the world.

Some key quotes revealing the central role IG Farben, which had a good number of Jewish executives, played in the rise of Hitler:

This is a grimly ironic story, since when Hitler took over Germany a year later, Jews were kicked out of IG Farben (and academics, and everywhere else) by the Gestapo and so on, and eventually sent to the death camps. One notable victim of this purge was Fritz Haber, who had invented the ammonia process that earned the IG so much money, and who had tried to shed his Jewish identity to become a Prussian militant (in charge of chemical warfare) in WW I. He died in 1937 as an exile, convinced he had ‘made grave errors in his life.’
The Zionist perspective, from Chaim Weizmann (also a chemist, much like Haber, except on the British side in WW I) and similiar people, was that obviously the integrationist Jews had the wrong idea, and that they had to go find some state for Jews, which would exclude all other groups. Weizmann, the real architect of Zionism, said this:
“But if the Jewish people will go build Palestine, the Jewish State will become a reality – a fact.”
So, Zionism really only dates to the early 20th century. Unfortunately much of the proposed “Jewish state” was inconveniently occupied by Muslims who had lived there for centuries, in general peace with Christian and Jewish neighbors, and these local Arab tribes were then driven off their land beginning in 1948, and have been persecuted by the “Jewish state” ever since, more or less proving that the whole idea was basically idiotic on numerous fronts, a throwback to the medieval era of religous states that modern democracies had rejected with the principle of ‘separation of church and state.’
This is why I would say that Israel in its current incarnation is no more a ‘true democracy’ than Saudi Arabia is (they claim to have democracy, too); no more than Iran is, which is why we should adopt the same diplomatic policy towards Israel and Saudi Arabia that we have towards Iran.
They could all just nuke each other and solve the problem for the rest of the world, with the Middle East left as a big smoking radioactive crater. . . a lasting monument to religious fanaticism. . . or we could pursue a diplomatic balancing strategy, aimed at forcing all the lunatics to live peacefully together in their asylum, instead of that other option.
One can find some Jews writing in its favor in the 18th century, and some steam picking up in the 19th. But it’s true that as anything more than an occasional idea, it developed heft in the 20th century, propelled in part by the romance that began in the 19th with fierce, triablistic nationalism.
Why all this IG Farben business? By the time Zyklon B came to be used to exterminate enemies of the state you can be damned well assured that there were no Jews in IG Farben management.
The most cursory knowledge of history would tell you that Jews were removed from professional and management positions long before the war broke out, and it was only then that the extermination programs really got under way. Human Rights Watch found that these assassinations violated international law that protects journalists, yet the Newseum has not only invited Leibovich but is also giving her a platform to discuss how the IDF “uses media and social media during its various campaigns.” In other words, she will be discussing how the IDF whitewashes its war crimes against Palestinians.
Last week the Palestinian Journalists’ Syndicate called on Newseum CEO Jeffrey Herbst to cancel the event. Herbst’s reply was that this event was an example of the Newseum’s commitment to free speech and fostering debate. Yet there are no Palestinian journalists, human rights defenders, or experts on the laws of war invited to speak. -As an institution dedicated to freedom of the press, it is disappointing that the Newseum is hosting former Israeli military spokesperson Avital Leibovich who justified the murder of two Palestinian journalists. Her entire role as a spokesperson was to whitewash the war crimes of the IDF to the international media.
-In 2012, Israel openly admitted to targeting two Palestinian journalists, Hussam Salama and Mahmoud al-Kumi. The Newseum lists them in its Journalists Memorial yet invites Leibovich who tried to justify their assassinations.
-Leibovich’s attempted justification of these executions was denounced by the Committee to Protect Journalists and Reporters Without Borders. The Palestinian Journalists’ Syndicate has called on the Newseum to disinvite her and it is a shame the Newseum has refused to do so.

These efforts to criminalize speech, certain to result in major blowback and vigorous challenges in the courts, can only indicate one of two things: either (a) the perpetrators are so certain that they will be able to get away with this mockery of democracy that they can’t even be bothered to pretend, or (b) they are on the verge of a full-fledged freakout at the possibility that BDS is playing a significant role in undermining the apartheid Israeli state and that role is growing in size and effectiveness.

What clearly worries them the most is not the frothing-at-the-mouth antisemites or conspiracy theorists, but progressive, open minded people who cannot be kept from learning ever more about the misguided policies of the Israeli state. If fact, I see the pronouncements of people like Cuomo and Clinton to be unproductive, actually raising awareness of those policies.

First of all, the article needs to be updated so that statements from the presidential candidates, or refusals to comment are included. Hillary’s support (as mentioned) for the idea generally is not sufficient
Then we need comment from every constitutional scholar and organization dealing with free speech… the ACLU and whatnot.
Then we need comment from Google, Microsoft, Apple, and every major corporation or organization that provides products or services of any kind to the NY government… and any that provide products or services to the US government as Schumer’s effort to nationalize this demands.
Since so many BDS supporters are Jewish, a lengthy article with comments from Rabbi’s and activists would seem to be in order as well.
None of this is criticism of the article… just pointing out some ideas to follow up with… and I’m sure there are other and better ideas too… but this obviously unconstitutional overreach needs to be confronted head on… and quickly.

I fail to see how BDS treatment against Iran for having nuclear ambitions and supporting terrorism is any different then the actions of Israel. Israel has a very successful nuclear weapon and also support terrorism around the globe. How is it that in one case the Muslim country of Iran their treatment is so how legitimate and to advocate for BDS is part of the policy of US but in aver similar case of Israel it is a crime no to advocate for an equivalent treatment for the same actions.
Another thing is religious persecution such as antisemitism is not the same as the political act like BDS that tries to hold a nation state accountable for injustice. If it were then we could not hold Iran, Saudi Arabia or ISIS accountable because it would be religious persecution of a nation state (or pseudo nation state in the case of ISIS) bound by religious law.
But we have seen that we can and do discriminate against Muslims but now it seems that is a crime to do it to the Jewish.

I just saw the BuzzFeed announcement rejecting Republican campaign advertising and my first impulse was to fist pump and shout about damn time. But then I realized that it could just as easily have been a gay, Black or Muslim group who they decided didn’t deserve access to the media.
So it seems to me that it should be the editorial side of the press who decides that worthless ideas don’t warrant coverage, no matter who expresses them. But the business side should not be denying access and services to anyone.
Unless I’m mistaken BuzzFeed is a private organization that can publish or not publish whatever it wants. Freedom of expression includes not being required to publish viewpoints with which one disagrees. The Catholic Church should not be required to publish material advocating atheism. I, for one, hope that The Intercept would turn down advertising from both Donald Trump and Hillary Clinton (but it’s The Intercept’s call, not mine).

I’m guessing the wording of the order was purposefully vague so action could be expanded while the breadth denied by people like you (who make ridiculous and false generalizations about a comment section filled with highly educated and informative people simply because they don’t support your ideology)
Of course, if the blowback becomes uncomfortable, they may claim the scale is more narrow than interpreted to try to salvage it… but it would still be unconstitutional and hypocritical.
And since investments would include pension funds for state workers which are supposed to be shielded from political influence, limiting the focus to just investments may actually cause a whole different set of headaches and blowback.
Using the political opinions of people that run businesses unrelated to those opinions is not an accepted way of making investment decisions.
And if the next governor has different political opinions he/she wishes to target, the whole notion of long term investments based on risk and return could be subverted to the short term political cycle.
But that angle isn’t what this article is about.
This just further demonstrates the inability of such people to present ANY reasonable argument against such boycotts. When they are unable to come up with a valid reason why people should not choose to boycott, they next try bullying them into submission. He needs to wake up and realise, that by doing so he has awakened many who would NOT under normal circumstances have joined any boycott, but on seeing such a law brought into being, will now do their best to boycott ALL Israeli products, and not just those from the illegal settlements.
Fun thought experiment, let’s say Wall Street Bank A manages the endowment of University B and the NY State Pension fund. University B adopts BDS and instructs Bank A to divest from Israeli stocks, etc. Does New York cancel the pension contract with Bank A if they perform their fiduciary duties to University B? My guess based on the EO is yes.
