We are in receipt of your letter dated September 23rd, 2016. Please allow this
letter to serve as TigerSwan?s formal response within the time frame requested in your
letter.
Please be advised that TigerSwan is not conducting ?private security services? in
North Dakota. Pursuant to North Dakota Century Code Section 43-30?01 (6), ?Private
Security Services" means the furnishing for hire security of?cers or other persons to:
a. Protect persons or preperty;
b. Prevent or detect theft or the unlawful taking of goods, wares, or
merchandise, or to prevent the misappropriation or concealment of goods, wares,
merchandise, money, bonds, stocks, choses in action, notes, or other valuable documents
or papers;
c. Control, regulate, or direct the ?ow of or movements of the public,
whether by vehicle or otherwise, to assure protection of private property;
d. Prevent or detect intrusion, unauthorized entry or activity, vandalism, or
trespass on private property;
e. Perform the service of a security of?cer or other person for any'of these
purposes; or
f. Transport money or negotiable securities to or from a ?nancial institution
or between business locations on a regular or daily basis, except for mail delivery.
TigerSwan has not hired anyone to provide any of the above-mentioned services
nor is it providing private security services.
TigerSwan appreciates the NDPISB board for doing its due diligence and since
TigerSwan is a licensed security services provider and compliant by the North Carolina
Board, we have submitted a packet to become a licensed private security firm within the
state of North Dakota should such services, which are not present at the time, be required
from TigerSwan.

'1 am returning your packet and fees for a Private Security Provider/Agency; I have outlined the fees and
guidelines below.
Criminal Records: $42.00
App Testing fee: $100.00
Private Security Fee: $130.00
Agency Fee (only if applying for Agency status): $250.00
You must supply pages I, 2, 3, and 6 from our website: along with all documentation
including proof of 4000 hours of Security Service, proof of 80 classroom hours, 2 passport size photos,
proof from the Secretary of State that you are authorized to work in ND, and Proof of Insurance which
must include 0 coverage, and 2 ?ngerprint cards. .
If obtaining Agency status, you must also submit page 4. You must include proof that you are a part
owner, member, or partner of the company. You must be the ?decision maker? as all correspondence will
go directly to you. When all documentation and fees are received and the background check comes back
clear, we will contact you to set up a date and time for the Security Provider Exam.
if obtaining Agency status, all employees must also submit an application, $67.00 fee, 2 ?ngerprint cards,
and BCI Release form. Corporate of?cers must submit the application along with 2 ?ngerprint cards, and
$42.00 criminal records search fee.

Hello
if his D0214 indicates military police or security, you can provide that as proof. it not, you can submit
something on company letterhead that states that he has at least 4000 hours of security work. This must
be signed by someone in authority of the company. The same goes for classroom training. Either
provide something on company letterhead, or you can provide proof from the college he attended. The
ciassroom courses must pertain to security and be at least 80 hours. Certificates are fine also, as long as
they state the number of ciassroom hours.

applying for security licensing.
it was returned tons and it was stated that we needed to present proof of security service hours and
classroom hours for Mr. Reese.
Mr. Reese has twenty?five years worth of security service hours in the military, and nine years operating
TigerSwan. He also has more than a sufficient amount of hours of classroom security studies, earning a
masters degree in international security.

This letter is to verify that Mr. James Patrick Reese has more than 4000 hours of security
work. Mr. Reese retired from the ?Delta Force? after 25 years as a decorated combat
leader. After retirement from the ?Delta orce?, Mr. Reese was named the Director of
Security Operations fora rnulti?billion?dollar international Fortune 100 Company. He
was responsible for implementing and reorganizing the security apparatus of the
company as well as the chairman?s critical infrastructure, maritime, aviation, domestic,
and international personal-security operations.
In 2008, he was specially recruited as the program director for the US Department of
State, Diplomatic Security, High Threat Security Services for Iraq and Afghanistan. In
2009, Mr. Reese began focusing on TigerSwan fulltirne. Throughout the last 7 years, he
has provided private security both directly on the ground and indirectly through
leadership from headquarters. He has also handled many private investigations for
Ti gerSwan.
Mr. Reese also has more than 80 hours of classroom instruction. He attended MIT from
20084009 and received a Masters in International Security and Relations in which he
earned 60 hours of classroom time. Mr. Reese is also a Resident Graduate of the Army
Command Staff College and War College, each equaled about 30 hours of classroom
time. He has 6 years of combat experience and also attended continuing education classes

1. Chairman, John Shorey, called the meeting to order at 11:05 am. Board members present:
Mike Stensrud, Rick Schuh, Nancy Miller, Ernie Thurman, and Randy Ziegler. Board member
absent, Mike Wetsch. Others present: Executive Director, Francine Johnson, Of?ce Assistant,
Cheryl Kruger, Legal Counsel, Monte Rogneby, Scott Williams and Keith Rowan representing
Pro Dog Security, Rory Schuh representing Securitas Security, Bill Gordon representing
Advance Security.
2. New board member, Ernie Thurman, was introduced and welcomed to the Board.
3. The minutes were reviewed from the previous meeting. Mike Stensrud made the motion to
accept the minutes and Rick Schuh seconded.
4. Of?cer elections from the previous meeting were revisited as suggested by Monte Rogneby.
Motion was made by Rick Schuh to maintain the current officers, John Shorey, Chairman, Mike
Stensrud, Vice-Chairman, and Nancy Miller, Treasurer. Ernie Thurman seconded.
5. Francine Johnson reported that the FBI audit was completed. The auditor instructed the
Board of?ce to change the current denial letter sent to applicants. He reiterated that the denial
letter cannot state the specific reason for the denial. He felt the current letter disclosed there was
a criminal record and that none of the reasons should be circled or noted to the security agency.
Previous protocol was that the agency was noti?ed that it was either a disclosure issue, a
deniable offense, or insuf?cient information was not provided. The auditor indicated the reasons
could still be listed on the denial letter but we could not circle which reason speci?cally because
that would be a violation of disclosure issue in his view. The Board determined that the letters
would still be sent to the agencies, but the speci?c reason would only be sent to the applicant
when he requested his record.
6. Cheryl Kruger informed the Board that the minutes will not be posted on the website until
they are approved by the Board at the next regularly scheduled Board meeting.
7. Cheryl Kruger informed the board that the BCI fees have been reduced by $2.00. Nancy
Miller made the motion to reduce the registration fees by $2.00, which equates to a $65.00 fee
rather than the $67.00 fee charged currently. This new fee would go into effect January 1, 20l 7.
Randy Ziegler seconded. A letter to all license holders will be sent to inform them of
the new change in fees.
8. Mike Stensrud reported there was no new information relating to BCI ?ngerprint processing
delays. ?0
9. Francine Johnson reported on the activity of Day Associates of
Montana. The of?ce received a complaint from the Golden Valley County Sheriffs Of?ce in
North Dakota that this company and employee performed investigative services in North Dakota.
Subsequent information and a letter from Day Associates con?rmed that they in fact
conducted investigative activities within North Dakota. Nancy Miller made the motion to send a
letter along with the pertinent to the Golden Valley States Attorney requesting they
prosecute this matter. Rick Schuh seconded it.
10. Cheryl Kruger provided the board with information on the complaint regarding FBS
Consulting Services conducting security work without being properly licensed. A letter was sent

to the company advising them of the violation. The work was being conducted on the Fort
Berthold Indian Reservation. Trevor Leach, of FBS Consulting, responded and indicated they
would stop the security work until they were properly licensed. There was some discussion by
the Board as to jurisdiction on reservation property. Mike Stensrud made the motion to send a
follow-up letter to FBS inquiring if they intend to become licensed and whether they are still
providing security services. Seconded by Rick Schuh.
11. Francine Johnson informed the board that the deadline for the Legislative pie?tiling had past.
Chairman, John Shorey, advised members to let the of?ce know if there are any legislative issues
pertaining to the Board in the upcoming session. Bill Gordon of Advance Security indicated he
is working on legislation to allow security of?cers in airports arrest powers on warrants. He
requested the Board compose this legislation. He was advised that the Board does not
author/draft legislation and that he needed to contact the legislative council as well as gaining a
legislator to sponsor his legislative proposal. Once he has the verbiage on the issue, the Board
would review that proposed legislation before any endorsement of it. Bill Gordon is pursuing a
change in arrest authority at the airports within the state. There was considerable discussion on
this matter and it was determined that Bill Gordon would need to make the necessary contacts
with regard to law enforcement, TSA, and legislative council and sponsorship in order to move
forward on this matter. No further action was taken by the Board.
12. Randy Zeigler left the meeting at noon due to other commitments.
l3. Francine Johnson provided a summary regarding Advance Security?s unregistered security
of?cers: Steve l-laggerty, Larry Olson, Wendell Rose, David Dalton, and James Lehse. These
individuals were not properly registered or renewed and were still placed on a security post. Bill
Gordon, license holder for Advance Security stated he was aware that the renewals were late, but
he made a business decision continue to have these individuals work for the company and remain
in violation. He stated he had sent a personal check to the Board because he didn?t have access
or availability to a company check. He stated this delayed the process as well, even though the
renewals were already late and beyond the timeline. He was informed that the board policy is
that of not accepting personal checks due to problems with NSF checks. Rick Schuh made the-
motion to ?ne Advance Security $1,000.00 and place them on 2 years? probation for the
violations of the ?ve employees. Ernie Thurman seconded.
14. Francine Johnson provided a summary fora second violation for Bill Gordon with Advance
Security. There were two additional unregistered employees: Logan Johnson and Muse Diriye.
Both worked security in North Dakota without being properly registered. Rick Schuh made a
motion to impose an additional $1,000.00 ?ne. Ernie Thurman seconded. If there is
another violation the Board will revisit the issue.
15. Cheryl Kruger provided an update on the Pro Dog Security?s violation of unregistered
employees: Scott Volker and Alex Fisher. Keith Rowan indicated that he had health issues at
that time and was unaware of the problem. He stated that Brett Anderson, former manager for
the company, was in charge of the registration. Because of legal issues with Brett Anderson,
Rowan inquired if Anderson?s registration card could be suspended. Rowan shared that
Anderson had embezzled from his company but he had chosen not to pursue action against him.
There were several integrity/ethics issues relating to Anderson. Keith Rowan indicated he will
send Brett Anderson?s card to the Board and he will advise Brett Anderson that his registration
has been suspended. The office will send a letter to Brett Anderson informing him oi" the
StISpension after receipt of the letter from Keith Rowan. On the issue of Scott Volker and Alex
Fisher, the NDPISB office received con?rmation from Keith Rowan that both employees were

removed from post. Rick Schuh made a motion to impose a $1,000.00 ?ne, compliance
checks to be submitted to the Board of?each month, the ability for
random compliance checks, and probation until December 16, 2018. Seconded by Nancy Miller.
Monte Rogneby, legal counsel for the Board, will compose the stipulation agreement.
.16. Cheryl Kruger provided a summary regarding violation of unregistered employees:
Duane Duppong, Jamie Castner, Kris Bauer, Alan Wilson, Shawn Iverson, Alicia I-laats, Shari
Selzer, and Steve Wiedman. Bill Leoni, license holder for GSSC, provided. a written response
indicating the Fargo of?ce was in charge of the renewals. He stated that their renewal
procedures were not correctly followed and they are addressing the issue internally. The letter
indicated these employees were removed from post until they received their renewed cards.
Rick Schuh made the motion to impose a $1,000.00 ?ne and 2 years probation. Seconded by
Ernie Thurman. Monte Rogneby, legal counsel for the Board, will compose the
stipulation agreement.
17. Cheryl Kruger provided a summary for the G48 violation of unregistered security officers:
Erica McCaghren and Robert Rigby. Erica McCaghren was inactivated in the tiles per
con?rmation from G48. A renewal was received for Erica McCaghren. Erica McCaghren
indicated that she had been working for G48 for the past 13 months. G48 indicated that it was
an accidental oversite and Erica McCaghren will be removed from post until properly registered.
Robert Rigby was inactivated by G48, but they did not return the pocket card to the of?ce. A
renewal form was submitted by G48 for Robert Rigby. Robert Rigby stated he has been
working since March of 2016. G48 responded stating they failed to reactivate Robert Rigby?s
card and he was working with his old card. They removed him from post and have not renewed
his application. Rick Schuh made the motion to impose a $1,000.00 ?ne and 2 years probation.
Seconded by Nancy Miller. Monte Rogneby, legal counsel for the Board, will compose
the stipulation agreement.
18. Cheryl Kruger provided a summary on the Armored Knights violation for the unregistered
security of?cers: Natalia Chouanard and James Fisher. A renewal was sent for both individuals,
but was returned to the Armored Knights due to incorrect fees. The license holder, Trevor
Millikan, stated that Natalia Chouanard did work on 10/1/16, but was taken off post when he
became aware that she did not have her new card. He resubmitted her renewal and Natalia
Chouanard?s card was issued on 10/7/16. There was a motion by Mike Stensrud to place a letter .
of reprimand in their ?le for Armored Knights. Seconded by Nancy Miller.
19. The ?nancial report was given by Nancy Miller. Total expenses for November were
$18,751.72. Total income was $8,984 with. a net loss of 89.76772. Total assets are
$226,794.28. Mike Stensrud made the motion to approve the treasurer report. Seconded by
Rick Schuh. Nancy Miller presented the new budget. She indicated that legal fees and
salaries may need adjustment after reviews at this meeting. Rick Schuh made the motion to
approve the budget with an amendment to legal fees and salary expense. Seconded by Ernie
Thurman.
20. Employee salary reviews for Francine Johnson and Cheryl Kruger were discussed. Francine
informed the Board that she will be retiring December 2017. Francine and Cheryl chose to leave
the reom white the Board discussed their wages. The Board gave Francine a 5% increase on her
salary. Cheryl will remain on salary full time until the end of March, 2017. A committee, which
will consist of all Board members present at this meeting, Mike Stensrud, Nancy Miller, John
Shorey, and Ernie Thurman willset up a special meeting via teleconference to discuss the

succession plan for the Executive Director position as well as Cheryl Kruger?s future wages and
bene?ts.
21. The meeting schedule for 2017 is: February 21, May 16, August 15, and November 28.
22. A motion was made by Nancy Miller to close the meeting for Executive Session for
attorney/client discussion concerning an investigation update on DAPL. Rick Schuh seconded
the motion. A roll call vote was taken. All were in favor of the session. The. public was
asked to leave and the Executive Session began at 2:50 pm.
23. The Executive Session was adjourned at 3:28 pm. and the public was invited back For the
open meeting.
24. The board was informed that a license application was received from Tiger Swan, one ol? the
companies af?liated with the DAPL project. It was noted there may be some issues concerning
the application. Monte Rogneby, counsel for the Board, indicated that if Tiger Swan wished to
appeal the standard process utilized on denials, the board may choose to hold a special meeting
to address any issues surrounding the application.
25. Additional housekeeping matters related to approval by Monte Rogneby with regard to
discussions between the new Treasurer, Nancy Miller, and outgoing Treasurer, John Shorey,
relating to financial questions. He indicated this would not be construed as an open meeting
violation or concern. They could consult each other on the financial matters. The Board was
also informed that the office was experiencing issues with some agencies requestirig/demanding
special treatment with regard to the turnaround time of registration cards. in an effort to be fair
to all agencies, the of?ce will institute the practice of mailing all registration cards so there is no
appearance of favoritism or special treatment to any company. The agencies can provide an
overnight label and envelope if they would like their cards sooner than what is delivered through
the US Postal system. .
26. Rick Schuh made the motion to adjourn the meeting. Seconded by Ernie Thurman.
The meeting adjourned at 3:40 p.111.

Ms. Johnson,
i am responding to your letter dated 19 December, 2016 reference the denial of my application base on
one of three issues listed in your letter.
i have never been convicted of any criminal crime in my life.
if i failed to disclose on the application all arrests, this was an oversight by me and my apologies. I
assumed if an arrest was dismissed by the district attorney, I would not be considered arrested for a
crime.
i am including a copy of the dismissal record from my lawyers from the state/county criminal records.
i am including a check for $25 and full disclosure.
My wife is diagnosed with bipolar disease. My wife had a depression act in luly 2015, where she
became belligerent and i had been advised over the years by mental health professionals to "Walk
Away? from the situation. i left my house when she went into her state. She became irate and
contacted the local police. was not home when the police arrived and my wife claimed we had an
argument and spit on her. i never heard from a police officer, was never questioned by a police officer,
and three days later while at my office, the local police (different jurisdiction) came to my office with a
warrant for my arrest for simple assault. was booked, saw the magistrate and given a court date. The
arresting officer had no evidence, had never interviewed me, and my wife admitted post arrest, that she
was under stress, could not reach me, and called the police. The district attorney dismissed the case
when it went to court.
i believe the denial is based off of inaccurate information and am requesting reconsideration by the
executive director.
I hope this letter and reconsideration by the Executive Director is deemed correct and we can move
forward to finish the application.
However, in the same letter i have the same 14 days to request an administrative review of my
application by the Board's Executive Committee. i feel this should be an additional 14 days if the
Executive Director denies my reconsideration upon that date, however, in keeping with the nature of
the letter I am requesting the Board Review so i do not fall out of the grace period of the 14 days as
stated in the letter.

1. Chairman John Shorey called the special meeting to order at 9:00 aan. Board members
present: Rick Schuh, Nancy Miller (via telephone), Ernie Thurman, Michael Wetsch, and
Randy Ziegler (ioined meeting at 9:30). Board member absent: Mike Stensrud. Others present:
Executive Director, Francine Johnson, Office Assistant, Cheryl Kruger, legal counsel, Monte
Rogneby.
2. Francine Johnson instructed the Board to destroy their copies of information relating to James
Reese and TigerSwan after the meeting. A motion was made by Rick Schuh to close the meeting
for an Executive Session for attorney/client discussion concerning the security provider/agency
application for James Reese and TigerSwan. Mike Wetsch seconded the motion. A roll cat! was
taken. The vote was unanimous. The Executive Session began at 9:04 am.
3. A motion was made by Mike Wetsch to adjourn the executive session. Seconded by Ernie
Thurman. The Executive Session was adjourned at 9:30 am. and the public was invited back for
the open session of the meeting.
4. Rick Schuh made the motion to deny the application for James Reese, of TigerSwan due to
the fact that the application is incomplete. The appeal by James Reese would also be denied
until the requested infounation is provided to the Boaid as to the nature and details of the
secu1ity and/or investigative activities conducted in the state of North Dakota. Seconded by
Ernie inn man.
5. Fiancine Johnson and Cheryl Kruger chose to leave the meeting so the board could discuss
salary/wage reviews and the succession plan. The board determined that they will revisit the
succession plan and Cheryl Kruger?s wage and bene?ts once Monte Rogneby provides them
with information requested on this matter. It was stated by Monte Rogneby that he would
provide that within a week. At that time, the committee will hold a special meeting to
discuss/assign duties to create the longnterm plan. The board revisited the wage for Francine
Johnson and determined that an adjustment was to be made. Rick Schuh made the motion to
increase the wage by $500 and Randy Ziegler seconded the motion.
6. Rick Sehnh made the motion to adjourn the meeting. Seconded by Mike Wetsch.
The meeting adjourned at 10:35 am.
