There’s not a lot that’s funny about President Trump’s January 27 executive order temporarily banning immigrants and refugees from seven majority Muslim countries.
But you have to admit this is a little funny: Trump’s executive order appears to brazenly violate another executive order about how the government should issue executive orders.
It’s sort of like the Supreme Court declaring the Constitution to be unconstitutional.
Presidential executive orders have ranged in history from piddling (giving the executive branch workforce a half day on Christmas Eve) to monumental (the Emancipation Proclamation). Somewhere nearer the piddling end of the spectrum is Executive Order 11030, signed by President Kennedy in 1962 and titled “Preparation, presentation, filing, and publication of Executive orders and proclamations.”
Nevertheless, recent presidents cared deeply about 11030 — in fact, they’ve cared to a degree that’s a little bizarre. For instance, George W. Bush signed Executive Order 13403 in 2006, changing the 1 1/2 inch left-hand margin for executive orders specified in 11030 to 1 inch.
Then in 2014, Obama noticed Bush’s executive order has merely struck out “1 1/2″ from 11030 and replaced it with “1.” This meant 11030 now demanded that executive orders have a left-hand margin of “1 inches.” Realizing this improper pluralization shook the foundations of the republic, Obama signed an executive order “striking ‘inches’ where it appears after the phrase ‘approximately 1′ and inserting ‘inch’.”
Trump’s violation of 11030 goes way beyond improper margins, however. Section 2 begins, “A proposed Executive order or proclamation shall first be submitted … to the Director of the Office of Management and Budget,” which is part of the White House. If the director of the OMB approves the executive order, it goes to the Justice Department and then to the president.
But there’s no sign Trump’s immigration executive order was routed through the OMB at the start, and lots of evidence it wasn’t.
We know the Justice Department’s Office of Legal Counsel received Trump’s executive order, because it sent a memo back to the White House approving it on January 27.
The OLC memo begins by stating that “the attached proposed Executive Order was prepared by the Domestic Policy Council and forwarded to this Department for review.” That is, it went directly from the Domestic Policy Council at the White House to the Justice Department — with no stop at the OMB in between.
Asked whether it had been receiving draft executive orders from the OMB, a Justice Department spokesperson responded: “We’ll decline and defer to OMB on that question.”
No one at the Office of Management and Budget responded at all to repeated inquiries about whether it was first office to receive Trump’s draft executive orders. The regular White House press office also did not respond. Notably, the OMB did not produce a one-paragraph “budgetary impact analysis” of Trump’s January 27 executive order until January 30.
Moreover, the river of White House leaks about the immigration executive order all agree that it was produced in a highly unconventional way. As Politico reported, the draft order “was so tightly held that White House aides, top Cabinet officials, Republican leaders on Capitol Hill and other Trump allies had no idea what was in it even when it was signed — and that was just how top advisers and aides wanted it.”
Of course, given all the grave potential flaws in Trump’s executive order, contravening Executive Order 11030 is the least of it. Kenneth Mayer, a professor at the University of Wisconsin-Madison and an academic expert on executive orders, says, “What’s the remedy for a violation? There probably isn’t one,” although he does believe “This could go into a claim that the government didn’t follow its own rules, and that makes it capricious.”
Its main significance is just as another sign that the Trump administration has no interest in being minimally competent. According to Matthew Miller, Eric Holder’s spokesperson when he was attorney general, “It wouldn’t surprise me if they didn’t know [Executive Order 11030] existed.” Mayer views the administration’s overall approach to executive orders as “shocking” and “just breathtaking, the degree of informality and casualness and disorganization.”

The US government has taken months and years to take action. Trump is trying to streamline the governmental process.
Anybody who finds their name/dept. is left off a memo/etc. is going to feel threatened and get in a snit. The president may find that some of the process is necessary in order to smooth obstruction and to clarify his intention(s).
Some of the departments are justified in being worried because bureaucracy just for the sake of bureaucracy is redundant and expensive and NEEDS to be trimmed. Smaller, more efficient government is going to force some people to find new jobs. The tax payer citizens have demanded that their government be less expensive and less intrusive. Trump is working to do what he said he would do.
The American people granted him this right. Not some joker living in their parents basement. Trump won the Presidency fair and square. Get over it!

E Os were authorized by and limited by law. It requires no congressional action unless congress disagrees with it. One president can issue an E O and the next can countermand it. The point here is how can the E O of one president control what another president can issue since the E O is not a statute of law. Since the E Os of one president is not binding on the next unless the next president agrees with the E O how thin does Trump’s E Os violate any previous E O?

Trump cited the reason for executive order was on the grounds that it was an issue of imminent to our national security. If Trump did not have a well documented history of calling this thing a Muslim Ban, the ban would have been able to remain in affect until the actual hearing. Since Trump and his trolls ran with calling it a Muslim ban. The judge was able to place a TRO on the ban for religious, equal protection, and due process violations of the constitution because there was overwhelming evidence to suggest it was religiously motivated.

The legal process, probably USC law, or United States Codes, has never been cited or quoted in all the news I have read, except for this one article on the 90 Day TRO on all muslim travelers from predominantly Muslim Countries, refugees or not.

Neither the legislative nor judicial branches have any authority to review these executive order procedural rules nor enforce them, so this article is really quite moot – legally speaking. The executive can willfully ignore its own procedural rules and there is no consequence. Or simply revoke or waive them, even retrospectively.

I don’t see how it’s funny even in a figurative sense. A president can overrule or override any former executive order. It’s analogous to the situation when Congress passes a bill that is inconsistent with a prior law. If the president signs the subsequent bill into law, it effectuates a partial repeal of the prior law.
Yes, it is sloppy. But sloppy doesn’t translate into it being unconstitutional or unlawful. Sloppy is the norm for the federal government.
What I don’t understand is this so-called expert on executive orders wondering out loud if any remedy exists for a bad EO. Of course a remedy exists. If the EO orders action that is unconstitutional or contrary to statutory law, it can be challenged in court. That has happened quire regularly. Schwartz can’t even get his accusation correct. There is no “ban,” and the word “Muslim” isn’t in the order.
And you can’t clearly see what the order effectively does. It bans Muslims.
It doesn’t matter what it’s called. It matters what it does. Your argument is nothing more than taking form over substance.
You shut your eyes to what the order is actually doing just because it doesn’t use a particular word. Weak!
Actually, it bans nationalities from Muslim countries. If it banned Muslims, people from Saudi Arabia, Pakistan, Afghanistan, and many other Muslim nations also would not be allowed to enter.
It bans Muslims and only identifies 7 countries. You’ve got it backwards.
If it’s upheld by the courts, then Trump would simply put every other country containing Muslim populations on the list. This is what’s called the ‘sniff’ test. Trump is merely testing the courts. Once this phase is validated by the courts, he’ll simply add all other countries onto the list.

Those 7 countries don’t have Trump industry businesses. The others have Trump hotels, condos, etc. He is not banning people from countries that provide him income.

In fact, Christians make up 10% of the population in Syria, hundreds of thousands of Christians in Iran, 11 MILLION Sudanese Christians.. the list goes on. So your “media talking point” holds no weight. This isn’t a Muslim ban and it does matter whether it’s called that or not.

The president has the power to restrict immigration from any class of individuals at any time for any reason. This includes countries, and religions.
It does matter what it’s called. Words do matter. Calling it a muslim ban makes it sound like the intent is to ban people that follow Islam. The intent is to give a new administration time to review the process by which people come into this country from 7 hotbed countries.
I am not a big Trump fan, but what this whole election has shown me, and articles with headlines like this reinforce, the press is as slimy as the Washington swamp. I don’t know what to do about it other than comment when I see deception.
I’d be open to reading an article about Trump’s ulterior motives in his EO’s, but give me some facts and earn my trust, although I’m not sure the latter is possible anymore.

– remove two orders for every new one added
– completely quantify and justify the cost
– maintain a 0 incremental cost balance between new & removed regulations
– subject the orders & budget to budgetary approval before implementing

Is it similar to Christian leaders who know the bible by heart but still have no problem of doing everything that is contrary to the gospels? – Is that what ‘funny’ is?

Some executive orders can be memorable: EO 10450 (Eisenhower, 1953), which provided for the removal of Federal employees suspected of being leftist or homosexual, or EO 9066 (FDR, 1942) which provided for the removal and detention of over 100,000 people of Japanese ancestry.
