Your request has been assigned Request ID No. 14780 for tracking purposes. You have requested the following records: I. copies of policies regarding bans, limitation or restrictions on publications on publications in DOC facilities; 2. documents identifying the names of books or publications have been banned, limited or restricted in any DOC facility ; and 3. copies of correspondence, reports, memos or other documents regarding The New Jim Crow. In response to item# I of your request, my office can provide the portion of NJ AC I OA Chapter 18 which addresses the topic of your request. My office can also provide the attached policy which generally applies to all NJDOC Facilities. The Prison Level Policies detailing the operations of the mailroom are exempt from disclosure pursuant to NJSA 47: lA-1 .1 "emergency or security information or procedures for any buildings or facility which, if disclosed, would jeopardize security of the building or facil ity or person therein", NJSA 47: I A- I . I "security measures and surveillance techniques which, if disclosed, would create a risk to the safety of persons [or] property" & NJAC: I OA:22-2.3(a)(9) All internal management procedures or any portion thereof including any portions of those procedures and/or any indexes or lists identifying the procedures re lated to the following; safety and security measures, inmate movement, staffing, investigative techniques, contraband detection, intelligence gathering techniques, structural or physical plant des igns, surveillance techniques, and search techniques. Records for item # 2 are attached. In response to item# 3 of your request, please be advised that the request is invalid and improper pursuant to MAG Entertainment LLC v. Di vision of Alcohol Beverage Control, 375 N.J. Super. 534 (App. Div. 2005). This poster describes the procedures for taking these actions. To file a complaint with the Government Records Council: Co ntact the GRC by phone at: 1-866-850-0511, by e-ma il at grc@dca.state.nj .us, or review the GRC web site at www.nj.gov/grc for information and to regi ster your complaint. The GRC staff may be able to help resolve the problem over the phone. If not, you can receive a complaint form through the mail or from the web site. When you file the w ritten complaint, the GRC w ill offer you and the public agency nonadversarial, impartial mediation. If mediat ion is not agreed to or fa ils, the GRC w ill investigate t he complaint. Policy Title: Effective Date: August1,2003 Inmate Personal Property Policy Number IMM.009.001 Revised: June 14, 2007 Page 2 of 3 property held by a correctional facility on behalf of an inmate and handled in accordance with N.J.A.C. 10A:1-11 New Jersey Department of Corrections or NJ DOC means that agency of the Executive Branch of the New Jersey State Government whose functions are to protect the public and provide for the custody, care, discipline, training and treatment of persons committed to the State correctional facilities. Non-permissible prooertv means property that is not authorized for retention, or exceeds the permitted amount indicated on a list of permissible property. Examples of non-permissible property include, but are not limited to, an unauthorized item received by an inmate through the mail or from a source of sale, an item retained by the inmate who receives notice that such item has been deleted from the permissible property list, or an item the inmate has in his or her possession that was permitted in a certain unit or facility that is not permitted in another unit or facility. Ill. POLICY A. IV. It is the policy of the New Jersey Department of Corrections that inmates shall be permitted to possess a reasonable amount of personal property. Each correctional facility shall develop a written list of permissible personal property, the items and the number of permissible personal property items that may be retained in the possession of the inmate. This list shall be reviewed and updated annually by the Administrator or designee and forwarded to the appropriate Assistant Commissioner for review and approval. B. Regulations concerning inmate personal property, the list of permissible personal property items and the permissible amounts, including state-issued personal property and commissary items shall be included in each NJ DOC correctional facility Inmate Handbook. New regulations regarding inmate personal property, and/or revisions to the list established during the course of the year, shall be posted in the inmate housing units and incorporated into the next revision of the NJ DOC correctional facility Inmate Handbook. C. Permissible inmate personal property may be received from source of sale only, in accordance with N.J.A.C. 10A:18-4, "Publications" and N.J.A.C. 10A:18-5, "Packages". D. Pursuant to N.J.A.C. 1OA:1-11.5, all appliances must be marked or engraved with the inmate name and inmate number, and must be sealed using a departmentally-authorized security seal. E. Inmate personal property shall be inventoried and non-permissible property items disposed of in accordance with N.J.A.C. 10A:1-11 "Personal property of inmates". Non-permissible prooertv means property that is not authorized for retention, or exceeds the permitted amount indicated on a list of permissible property. Examples of non-permissible property include, but are not limited to, an unauthorized item received by an inmate through the mail or from a source of sale, an item retained by the inmate who receives notice that such item has been deleted from the permissible property list, or an item the inmate has in his or her possession that was permitted in a certain unit or facility that is not permitted in another unit or facility. Ill. POLICY A. IV. It is the policy of the New Jersey Department of Corrections that inmates shall be permitted to possess a reasonable amount of personal property. Each correctional facility shall develop a written list of permissible personal property, the items and the number of permissible personal property items that may be retained in the possession of the inmate. This list shall be reviewed and updated annually by the Administrator or designee and forwarded to the appropriate Assistant Commissioner for review and approval. B. Regulations concerning inmate personal property, the list of permissible personal property items and the permissible amounts, including state-issued personal property and commissary items shall be included in each NJ DOC correctional facility Inmate Handbook. New regulations regarding inmate personal property, and/or revisions to the list established during the course of the year, shall be posted in the inmate housing units and incorporated into the next revision of the NJ DOC correctional facility Inmate Handbook. C. Permissible inmate personal property may be received from source of sale only, in accordance with N.J.A.C. 10A:18-4, "Publications" and N.J.A.C. 10A:18-5, "Packages". D. Pursuant to N.J.A.C. 1OA:1-11.5, all appliances must be marked or engraved with the inmate name and inmate number, and must be sealed using a departmentally-authorized security seal. E. Inmate personal property shall be inventoried and non-permissible property items disposed of in accordance with N.J.A.C. 10A:1-11 "Personal property of inmates". PROCEDURES Procedures relating to inmate possession and control of personal property while incarcerated are found in Division of Operations Level I Internal Management Procedures.
